The undersigned covenants and agrees as follows:
GENERAL RELEASE. The undersigned, regardless of whether or not the undersigned is an invitee to and upon the property of Double B Acres located at 3524 Conway Road, in Farmington, Missouri (the "Property"), hereby agrees to defend, indemnify and hold harmless the following entities and/or persons:
The Property and its owners, officers, employees, administrators, agents, heirs, successors, legal representatives or assigns, Buck Huff, and/or Bobbie Huff, their employees, administrators, agents, heirs, successors, legal representatives or assigns, in both public and private capacity (jointly and severally, the "Released Parties");
AND the undersigned hereby releases and waives any claims that the undersigned may now or hereafter have against the aforementioned Released Parties, including, but not limited to:
- Bodily injury, death, and damages thereof including loss of income, earnings, pain and suffering, emotional or mental distress;
- any and all medical expenses; and
- any other liabilities which may be given rise to in causes of action, suits, demands, losses, damages,
costs or expenses of whatever kind or nature, including attorney's fees which the undersigned may incur as a result of any injury to the undersigned or personal property of the undersigned while the undersigned is present upon the Property.
FURTHER, the undersigned hereby represents that the undersigned is over the age of eighteen (18).
FURTHER, the undersigned represents that the undersigned is duly authorized to, and does hereby sign this
waiver and release form on behalf of themself, their children/legal ward(s) and any other guests, employees or
agents of the undersigned accompanying the undersigned upon the Property on the date appearing above the
undersigned's signature affixed to this document.
ASSUMPTION OF RISK. The undersigned acknowledges and understands that:
- Any activities the undersigned may undertake while on the Property, whether equestrian-related or not,
may involve inherent or extreme risk of personal injury and injury to personal property, including horses.
- Injuries may be caused by a collision with another equine, another animal, a person, or an object, the
potential of an equine activity participant to act in a negligent manner that may contribute to injury, death, or loss to the person of the participant or to other persons, including, but not limited to:
a. failure to maintain control over an equine;
b. the propensity of an equine to behave in ways that may result in injury, death, or loss to persons on or around the equine; and
c.the unpredictability of an equine's reaction to sounds, sudden movement, unfamiliar objects, persons, or other animals.
- There are other inherent risks which may be associated with activities upon the Property, whether or
not equine-related, including, but not limited to, environmental and/or terrain conditions such as uneven or damaged terrain, the presence of moisture or mud, obstacles and obstructions upon or under the terrain, and other natural or man-made conditions which may be hazardous to the undersigned or create hazards to the undersigned's activities while upon the Property.
BINDING EFFECT. The foregoing provisions shall be fully binding upon and shall be effective against the undersigned, the undersigned's heirs, successors, legal representatives or assigns and shall apply to the undersigned personally, the undersigned's family, guests, employees or agents.
IN WITNESS WHEREOF, the undersigned declares that the provisions of this Release and Waiver of Claims have been completely read, are fully understood, are voluntarily accepted, and that said Release and Waiver of Claims is hereby executed this _____ day of ____________, in the year ________ by the undersigned:
