WITNESS THIS AGREEMENT this _____ day of_________20____, by and between Double B Acres, (hereinafter referred to as “Trainer” and/or "Double B Acres") and _________________________________, (hereinafter referred to as “Owner”).
IF OWNER IS A MINOR, OWNER'S PARENT OR GUARDIAN MUST SIGN ON BEHALF OF MINOR.
Trainer agrees to accept Owners horse _____________________ for training and it is the Owner's plan and intention to place this horse into training.
1. FEES, TERMS AND LOCATION:
Owner shall pay the Trainer for professional services as described below.
The fee is $300.00 for 30 days. The Owner shall pay $150.00 on the 15th day of training and the remaining $150.00 on the 30th day.
Changes in rates or other charges are subject to alteration upon 15 days notice to Owner.
All expenses incurred for veterinarians, shoeing, or other out-of-pocket cost shall be paid by Owner upon receipt of bill from Trainer.
Trainer agrees to provide adequate facilities for normal and reasonable care required maintaining the health and well being of the animal in training. Owner acknowledges they have inspected the facilities and finds same in safe and acceptable order.
2. TRAINING OF HORSE:
The Trainer shall train horse and perform all services in accordance with generally accepted professional standards. Trainer does not and can not guarantee the effect of the training program or that any particular result will be achieved, since that depends a great deal on the individual physical and mental ability of each horse. Trainer shall furnish all labor, provide suitable facilities and care for horse in an adequate manner.
Trainer reserves the right to refuse any horse upon the premises if same does not appear to Trainer to be in good health, or is deemed dangerous or undesirable.
3. FEED, FACILITIES AND SERVICES:
Trainer agrees to provide adequate facilities for normal and reasonable care required maintaining the health and well being of the animal in training. Trainer will provide labor to feed, water and maintain horse. Owner is responsible to provide, upon delivery of horse, enough feed, hay or any type of supplement the horse requires to last during the 30-day training period.
Owner is also required to provide a large capacity metal trash can with a tight fitting lid to store their horse’s feed in. The can and lid should be marked with their horse’s name on it. This “feed can” will be returned to Owner after the training period is completed. We also recommend that you bring your grain scoop or utensil to measure out horse’s ration so that Trainer will be sure to provide the correct ration for your horse. Your horse’s safety and well being is a very big concern at Double B Acres.
Owner may store certain tack and equipment on the premises of Trainer at no additional charge to Owner. However, Trainer shall not be responsible for theft, loss, damage or disappearance of any tack or equipment or other property stored at the facility as same is stored at Owner’s risk.
The Owner fully understands that Trainer does not carry any insurance on any horse not owned by it for boarding or training or for any other purposes, whether public liability, accidental injury, theft or equine mortality insurance and that all risks connected with boarding, training, or for any other reason for which the horse(s) in the possession of, and on the premises of Trainer are to be borne by Owner.
4. RISK OF LOSS AND STANDARD CARE:
During the time the horse is in the custody of Trainer, Trainer shall not be liable for any sickness, disease, theft, death or injury which may be suffered by the horse or any other cause of action whatsoever, arising out of or being connected in any way with boarding or training of said horse.
Death of horses: It is hereby agreed that in the event of the death of the horse, it is Owners legal and financial responsibility to have said horse removed immediately from premises.
5. HOLD HARMLESS:
Owner agrees to hold Trainer harmless from any and all claims arising from damage or injury caused by said horse to anyone, and defend Trainer from any such claims. Owner agrees to disclose any and all hazardous or dangerous propensities of horse boarded or trained with Trainer. Trainer reserves the right to notify owner within 24 hours of horse’s arrival if said horse, in Trainer’s opinion, is dangerous, untrainable, unhealthy, handicapped, or otherwise unfit for boarding or training. Upon such notification, Owner shall remove said horse within 24 hours.
6. VETERINARIAN, SHOEING AND RELATED SERVICES:
Owner assumes responsibility for arranging veterinarian and farrier services as necessary and all expenses incurred with same.
7. EMERGENCY CARE
Trainer agrees to attempt to contact Owner should Trainer determine veterinary treatment is needed for said horse or if farrier service is needed for said horse. If Trainer is unable to contact Owner, Trainer is then authorized to secure emergency veterinary, or farrier care required for the health and well being of said horse. The Owner shall pay all cost of such care.
Trainer shall assume that Owner desires surgical care if recommended by a veterinarian in the event of colic, or other life threatening illness, unless Trainer is instructed by Owner or on Owner’s information Sheets, that the horse is not a surgical candidate.
Owner agrees to notify of any and all changes of addresses, emergency telephone numbers, itineraries or other information reasonably necessary to contact Owner in the event of an emergency. Owner shall notify Trainer as to what party is authorized to make decisions in the Owners place with regard to the health, well being and medical treatment of the horse.
Owner shall submit a fully completed Owner’s Information sheet for each horse they may have on the Trainer’s premises. The Owner Information sheet will be required on or before the day the horse is delivered to Trainer’s premises. At that same time, Owner will also provide proof of current Coggins and vaccinations.
8. INHERENT RISKS AND ASSUMPTION OF RISKS:
The undersigned acknowledges there are inherent risks associated with equine activities such as described below, and hereby expressly assumes all risks associated with participating in such activities. The inherent risks include, but are not limited to the propensity of equines to behave in ways such as, running, bucking, biting, kicking, shying, stumbling, rearing, falling or stepping on, that may result in an injury, harm or death to persons on or around them; the unpredictability of equine’s reaction to such things as sound, sudden movement and unfamiliar objects, persons or other animals; certain hazards such as surface and subsurface conditions; collisions with other animals; the limited availability of emergency medical care; and the potential of a participant to act in a negligent matter that may contribute to injury to the participant or others, such as failing to maintain control over the animal or not acting within such participant’s ability.
WARNING: Under Missouri Law, an equine professional is not liable for an injury to or the death of a participant in equine activities resulting from the inherent risks of equine activities pursuant to the Revised Statutes of Missouri.
9. RULES AND REGULATIONS
The Owner agrees to abide by all rules and regulations of the Trainer while on the said property of DOUBLE B ACRES or rental property obtained by DOUBLE B ACRES.
